1. Introduction

These Terms of Service (“Terms”) govern your use of the services provided by Hammer Driveway Sealing Co. (“we”, “us”, “our”). By requesting or accepting our services, you agree to be bound by these Terms.

2. Services Offered

We provide driveway sealing services, including surface preparation, power cleaning, application of water‑based sealant, and follow‑up support.
Our water‑based product offers a matte finish and is comparable to refined tar sealers. Typical drying and curing time is 24‑48 hours.

3. Quotations & Pricing

We provide quotes based on submitted information about your driveway. Our Price‑Beat Guarantee: if you provide a written quote from a competitor, we will match it and then discount our price by an additional 10%.
Group bookings (multiple driveways on the same street) are eligible for exclusive discounts.

4. Scheduling & Delays

Once a quote is accepted and booking confirmed, we schedule the job.
In cases of adverse weather (e.g., rain day) or other unforeseen conditions, we will notify you and reschedule promptly. Extended delays do not constitute a breach of these Terms.

5. Payment Terms

Payment details (deposit, final payment, accepted methods) will be specified in your quote. Final payment is due upon job completion unless otherwise agreed in writing.

6. Site Preparation & Access

You agree to provide safe, unobstructed access to the driveway.
Vehicles, debris, and loose items must be removed prior to our arrival.
You acknowledge the area must remain free of vehicle traffic during the curing period (typically 24‑48 hours).

7. Warranty & Follow‑Up

We guarantee workmanship for one (1) year. The water‑based sealant performance is subject to proper maintenance and conditions. Follow‑up service (inspections, touch‑ups) may be offered at our discretion.

8. Limitations of Liability

We are not liable for damage caused by pre‑existing conditions, structural issues of driveway substrate, or neglect/misuse post‑service. Our total liability shall not exceed the amount paid by you for the relevant service.

9. Cancellation & Rescheduling

If you cancel less than 24 hours prior to scheduled work, a cancellation fee may apply. We reserve the right to reschedule due to inclement weather or safety concerns without penalty to us.

10. Intellectual Property & Use of Media

We may photograph or film completed work for marketing purposes unless you provide written objection. All materials on our website (logos, text, images) are our property or licensed to us.

11. Privacy

We collect personal information to provide quotes and services. Our use of your data is governed by our Privacy Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada. Disputes will be resolved in the courts of Hamilton, Ontario.

13. Changes to Terms

We reserve the right to update these Terms at any time. The current version will be posted on our website. Your continued use of our services constitutes acceptance of the revised Terms.
